Michael Jackson Brand Expands; Mom Considering Wrongful-Death Suit

Michael Jackson couture is just around the corner.
A judge on Monday approved deals proposed by the administrators of the artist’s estate to market clothing and various other types of Jackson-branded merchandise, but the wheeling and dealing ground to a halt when Katherine Jackson objected to a plan to take memorabilia that M.J. actually touched and wore on tour.
Not that the King of Pop’s mother thinks the memorabilia tour proposed by AEG Live is a bad idea. She just thinks there’s more gold in the mine that AEG has yet to tap into.
Burt Levitch, one of Katherine’s attorneys, said he feared that the administrators were trying to portray his client as greedy—which is not the case, he insisted. In addition to wanting to further discuss the split of the proceeds from such a venture, she harbors continued concerns about her son’s legacy.

On Friday, Katherine and her attorneys agreed to AEG’s sale of hours of Jackson rehearsal footage to Columbia Pictures for $60 million, and today they withdrew any objections to the various merchandising deals in the works.
Estate attorney Howard Weitzman warned that dragging their feet on the memorabilia tour, which needs to be finalized by Friday in order to time the opening of the exhibition to coincide with the film’s premiere, could cost them millions.
“I see the delay as a real problem for the estate,” agreed Los Angeles Superior Court Judge Mitchell Beckloff, who set a follow-up hearing for Friday.
“She doesn’t own the property,” the judge said in reference to Katherine’s request for authority to sign off on the final deal. “There’s no reason to make her a signatory to those agreements.”
Katherine’s attorneys said today that they plan to show that “not only can more money be generated, but that the legacy can be better protected.”
Attorney Margaret Lodise, whom Beckloff appointed last week to represent the interests of Jackson children Prince Michael, Paris and Prince II, says that she won’t stand in the way of the memorabilia tour.
“I hope we won’t be nitpicking each and every deal,” Weitzman said after court today, “because there will be many deals in the future.”
Meanwhile, Beckloff confirmed that cardiologist Conrad Murray’s name “has been floated” as a potential target for a wrongful-death lawsuit, but that it was “premature” to discuss details.
Murray, who was employed as Jackson’s private doctor and was at the singer’s home when he went into cardiac arrest June 25, is currently the subject of a manslaughter investigation being conducted by the LAPD in accordance with the Drug Enforcement Administration and California Attorney General’s Office.

Hailey Glassman Trying to Be Happy With Jon in a “Dirty, Dirty World”

Hailey Glassman is just “a normal 22-year-old girl.” So how did she turn into “the goldfish that was put in the piranha tank”?
The admitted college-era weed smoker (it happens) exclusively tells E! News that, about five years ago, the only thing she had to say about the Jon & Kate Plus 8 star was, “Wow, you’ve got a lot of kids.”
But now, she is really, truly in love with her family friend turned boyfriend, and she thinks there is plenty of blame to go around for her 15-plus minutes of infamy.
“Before all this, I was happy-go-lucky,” Glassman said in a recent sit-down.
“I was never a follower. I was never a gossiper. I did my own thing. To be honest, this whole thing, I have lost my happiness through this all. I don’t want to say the public and media stripped me of my self-esteem. But they really have. I’ve been the sacrificial lamb in this situation.”

And don’t even get her started on TLC’s role in this fiasco.
“More like the lying channel,” Glassman said when reminded that TLC stood for The Learning Channel. TLC didn’t allow [Jon and Kate Gosselin] to come out and say their marriage was done a year ago,” she said. But “no network owns what I can and cannot say.”
And the gist of what she has to say is that she and Mr. Gosselin didn’t hook up until after his marriage had come undone, and they went from friends to best friends to more.
“It’s very carefree and fun,” she said of their relationship. “We just laugh—like, our best times are when it’s just me and him.
“We both enjoy just simple things in life,” she said, citing their mutual love of snowboarding, watching movies, playing pool and other “normal” activities.
Having already dismissed Gosselin’s rumored girlfriend No. 2, Kate Major, as being “cuckoo, cuckoo,” Glassman also insists that nanny Stephanie Santoro is nothing but a nanny.
“Jon has a good heart, she has a child and he felt bad. He knows how it feels to have a child and not be able to afford, you know, so he hired her to give her a job.”
As for her future with the father of eight, Glassman says her current objective is happiness for all.
“I don’t like to talk in the future,” she said. “I like to live in the present. As of right now, I want to be happy. I want Jon to be happy. I want every side to be happy.
“People need to realize there’s two sides to every story…TLC, they’re telling something but the truth is always in that fuzzy area. You can’t touch it, but only the people contracted can see it, but no one can say it.
“It’s a dirty, dirty world. Bamboozling, this world. I didn’t know any of this would happen,” Glassman added, referrering once again to the media poo-storm.
“If I wanted fame, don’t you think I would be out all the time? I stay in my house. I’ve been staying home with my parents because I feel safe there.”

UPDATE: Attorney Martin Singer maintains that, despite its sexy nature, the video is not a sex tape.
“This is simply a private, consensual moment involving a married couple, shot several years ago, which was never intended to be seen by the public,” Singer said in a statement Monday.
“Although the participants are nude, the tape is not a ’sex tape.’ It is a private tape made for only my clients’ personal use, and nobody has the right to exploit it. If anyone exploits the tape, they will be violating my clients’ rights and will be exposed to significant liability.”

Gawker has unearthed some video of a sex tape featuring Eric Dane (who plays arrogant and sexy plastic surgeon Mark “McSteamy” Sloan on the hit ABC series), Dane’s wife, Rebecca Gayheart, and ex-beauty queen/Playboy model Kari Ann Peniche.
The threesome wander around someone’s house naked and seemingly baked, and then slip into something more comfortable, a bathtub. They also discuss each other’s porn names and generally appear to be enjoying themselves. (Beyond some nudity, the Gawker clip doesn’t show any actual sexcapades.)

Is There Any Good Dirt on the Jonas Brothers?

The Jonas Brothers seem so clean-cut and well, normal, which seems so unusual for young stars these days, surely there’s some dirt you can dish on them?

Oh yes. Yes, there is. Those three guys may wear promise rings and credit God for their success, and field all manner of praise from journalists for their politeness and admiration of accomplished musicians. But they are not free of sin. Behold! The top five biggest Jonas brothers scandals! Revealed! …

1. Their ladies take the Lord’s name. In vain. Both Miley Cyrus—a known off-and-on associate of Nick Jonas—and Danielle Deleasa, fiance to Kevin, have been quoted as saying “Oh my God.” Has anyone in the Jonas family taken any sort of action? No. No they have not.
2. Someone out there does not think the Jonas Brothers are amazing. Trace Cyrus, Miley’s brother, was recently quoted as saying the Jonas Brothers are “fake.” What manner of insult did the brothers commit to offend this tattoo-covered man with multiple piercings and no discernible career? The entire Jonas camp is closing ranks. Clearly they’re hiding something.
3. The Jonas brothers used to charge about $40 per concert ticket. Now they charge closer to $80, and all we’re getting is front-row seats, killer special effects, real singers playing real instruments, and a band who has sold roughly 8 million records. Know who else charges that kind of money? Springsteen. Charges roughly 90 bucks per ticket. Just what are these punks trying to say?
4. Nick got snippy once when a reporter asked about that ticket price.
5. They are completely lying about their age. “”What people don’t really understand,” Joe Jonas told a Pittsburgh Tribune-Review reporter, “is that we secretly are over the age of 40, and so we’ve already lived through our shelf life time, so we’re pretty just going back and trying to reinvent ourselves.”

Everyone’s favorite shrieking judge is calling out little ol’ Paula Abdul.
“She might be sitting next to me this season, you never know,” So You Think You Can Dance’s Mary Murphy told 101cute at the opening of the new L.A. resort Terranea last night. “I’m not sure America’s ready for that.”
While we definitely agree with that sentiment (Paula’s mindless blabber mixed with the pitch of Mary’s squeal—can you imagine?!), the SYTYCD judge took it a step further on the Paula front:
“There could be a catfight between me and Paula—or a dance fight!”

Uh-oh, is trouble already a-brewin’ between the former American Idol judge and her potential Dance partner?
Maybe so…or maybe Mary’s just working it for the press. Honestly, we don’t know and we don’t care—we just like it.
So who would take the crown in this so-called “dance fight”? “I know one thing for sure, I could definitely beat her at the tango, quickstep and cha-cha.” Does Mary give Paula any credit at all? “She’d probably get me in hip-hop, I’d have to say.”
If Paula does come on board SYTYCD, Mary has a plan to keep the peace: “We’d actually have to put Nigel [Lythgoe] in the middle, and I’m not sure he’s ready for that.”
Did the voice behind SYTYCD have any final fightin’ words for Abdul? Only when asked who the better judge is. Says Mary, with that ever-present smile on her face: “I would be. I have to be honest, a girl knows what she’s talking about.” Ooh, burn!

Blame Michael Jackson, Not His Doctors!

Call it the ultimate whodunit twist: Michael Jackson did it.
As famed attorney Mark Geragos told E! News, a Jackson homicide trial in which Dr. Conrad Murray is the defendant may well turn into a forum in which Jackson himself is on trial.
“Ultimately, that may be what the defense is,” Geragos said.
Don’t go there, you say? Don’t blame the victim, you cry?
You may be right. But if a lawyer is potentially going to go there, then we’re going to go there first. Just to wrap our minds around the concept: Michael Jackson. Responsible for his own death.
Now, criminally speaking, Jackson, by virtue of being dead, is in the clear. While dead guys are dead, they’re also beyond the reach of the law.

But what if Jackson weren’t dead?
What if the events leading up to this past June 25 occurred exactly as they occurred with one exception: Jackson doesn’t die. Maybe he’s revived in the ambulance. Maybe he’s revived at the hospital. In any case, he’s alive.
And it’s his turn to face the music. For doctor shopping, maybe. For filling prescriptions for Call of the Wild author Jack London, perhaps. For dragging one of his own sons’ names into the pharmaceutical saga, unbelievably.
Can you blame the victim when the victim isn’t blameless?
Ethically, we get it: Doctors are supposed to look out for you. It’s like John Michael O’Brien, assistant professor at the College of Notre Dame of Maryland School of Pharmacy, told us: “If Joe Sixpack took his child to the family physician and said, ‘I want my child to have HGH or steroids,’ a rational physician would say, ‘Are you crazy?’”
Legally, we get it, too. It’s like California criminal defense attorney Michael L. Crowley told us: “Generally speaking, we put the responsibility on the doctors for prescribing.”
And given that Jackson had no prior record, Peter Knecht, another California criminal defense attorney, told us that even if the singer had been charged with criminal wrongdoing, he wouldn’t have been treated like a criminal: “He would have been able to take advantage of the civil addict programs.”
In the end, his record probably would’ve been wiped clean. Which isn’t necessarily the same as saying his slate would’ve been wiped clean.
Jackson, for all his Peter Pan ways, was a grown man. And by account after account, he was begging to be given things, to be prescribed drugs that aren’t good for grown elephants. According to his former nutrionist, he asked for Diprivan. According to some reports, he died from Diprivan.
The coldest devil’s advocate position says Jackson was a wrong-way driver on a one-way street—destined for disaster—and that not any one member of his entourage, not any one doctor on his tab, not any one drug, is to blame for his demise.
There, we said it. Said what a lawyer might one day say in court. (Mind you, no one—not Murray, not anyone—has been charged with wrongdoing in Jackson’s death.)
Do we feel better? No.
“If Michael Jackson was suffering from the mental disorder of addiction,” O’Brien reminded us, “then I would say Michael Jackson was sick.”
And can you blame the sick for being sick?
Fortunately, we’re not the ones who may have to answer, or argue, that in court.

White House appears ready to drop

WASHINGTON – Bowing to Republican pressure, President Barack Obama’s administration signaled on Sunday it is ready to abandon the idea of giving Americans the option of government-run insurance as part of a new health care system.
Facing mounting opposition to the overhaul, administration officials left open the chance for a compromise with Republicans that would include health insurance cooperatives instead of a government-run plan. Such a concession probably would enrage Obama’s liberal supporters but could deliver a much-needed victory on a top domestic priority opposed by GOP lawmakers.

Officials from both political parties reached across the aisle in an effort to find compromises on proposals they left behind when they returned to their districts for an August recess. Obama had sought the government to run a health insurance organization to help cover the nation’s almost 50 million uninsured, but he never made it a deal breaker in a broad set of ideas that has Republicans unified in opposition.
Health and Human Services Secretary Kathleen Sebelius said that government alternative to private health insurance is “not the essential element” of the administration’s health care overhaul. The White House would be open to co-ops, she said, a sign that Democrats want a compromise so they can declare a victory.
Under a proposal by Sen. Kent Conrad, D-N.D., consumer-owned nonprofit cooperatives would sell insurance in competition with private industry, not unlike the way electric and agriculture co-ops operate, especially in rural states such as his own.
With $3 billion to $4 billion in initial support from the government, the co-ops would operate under a national structure with state affiliates, but independent of the government. They would be required to maintain the type of financial reserves that private companies are required to keep in case of unexpectedly high claims.
“I think there will be a competitor to private insurers,” Sebelius said. “That’s really the essential part, is you don’t turn over the whole new marketplace to private insurance companies and trust them to do the right thing.”
Obama’s spokesman refused to say a public option was a make-or-break choice.
“What I am saying is the bottom line for this for the president is, what we have to have is choice and competition in the insurance market,” White House press secretary Robert Gibbs said Sunday.
A day before, Obama appeared to hedge his bets.
“All I’m saying is, though, that the public option, whether we have it or we don’t have it, is not the entirety of health care reform,” Obama said at a town hall meeting in Grand Junction, Colo. “This is just one sliver of it, one aspect of it.”
Lawmakers have discussed the co-op model for months although the Democratic leadership and the White House have said they prefer a government-run option.
Conrad, chairman of the Senate Budget Committee, called the argument for a government-run public plan little more than a “wasted effort.” He added there are enough votes in the Senate for a cooperative plan.
“It’s not government-run and government-controlled,” he said. “It’s membership-run and membership-controlled. But it does provide a nonprofit competitor for the for-profit insurance companies, and that’s why it has appeal on both sides.”
Sen. Richard Shelby, R-Ala., said Obama’s team is making a political calculation and embracing the co-op alternative as “a step away from the government takeover of the health care system” that the GOP has pummeled.
“I don’t know if it will do everything people want, but we ought to look at it. I think it’s a far cry from the original proposals,” he said.
Republicans say a public option would have unfair advantages that would drive private insurers out of business. Critics say co-ops would not be genuine public options for health insurance.
Rep. Eddie Bernice Johnson, D-Texas, said it would be difficult to pass any legislation through the Democratic-controlled Congress without the promised public plan.
“We’ll have the same number of people uninsured,” she said. “If the insurance companies wanted to insure these people now, they’d be insured.”
Rep. Tom Price, R-Ga., said the Democrats’ option would force individuals from their private plans to a government-run plan, a claim that the nonpartisan Congressional Budget Office supports.
“There is a way to get folks insured without having the government option,” he said.
A shift to a cooperative plan would certainly give some cover to fiscally conservative Blue Dog Democrats who are hardly cheering for the government-run plan.
“The reality is that it takes 60 percent to get this done in the Senate. It’s probably going to have to be bipartisan in the Senate, which I think it should be,” said Rep. Mike Ross, D-Ark., who added that the proposals still need changes before he can support them.
Obama, writing in Sunday’s New York Times, said political maneuvers should be excluded from the debate.
“In the coming weeks, the cynics and the naysayers will continue to exploit fear and concerns for political gain,” he wrote. “But for all the scare tactics out there, what’s truly scary — truly risky — is the prospect of doing nothing.”
Congress’ proposals, however, seemed likely to strike end-of-life counseling sessions. Former Alaska Gov. Sarah Palin has called the session “death panels,” a label that has drawn rebuke from her fellow Republicans as well as Democrats.
Sen. Orrin Hatch, R-Utah, declined to criticize Palin’s comments and said Obama wants to create a government-run panel to advise what types of care would be available to citizens.
“In all honesty, I don’t want a bunch of nameless, faceless bureaucrats setting health care for my aged citizens in Utah,” Hatch said.
Sebelius said the end-of-life proposal was likely to be dropped from the final bill.
“We wanted to make sure doctors were reimbursed for that very important consultation if family members chose to make it, and instead it’s been turned into this scare tactic and probably will be off the table,” she said.
Sebelius spoke on CNN’s “State of the Union” and ABC’s “This Week.” Gibbs appeared on CBS’ “Face the Nation.” Conrad and Shelby appeared on “Fox News Sunday.” Johnson, Price and Ross spoke with “State of the Union.” Hatch was interviewed on “This Week.
